All prospective bidders must register to participate in the auction. Registration must be done online at emeraldauctiongroup.com. Participation in the auction constitutes acceptance of these Terms & Conditions. If you do not agree, do not register or bid.
Online Only Auction
This is an Online Only Auction. Bids will be accepted solely from registered online bidders at emeraldauctiongroup.com.
Online bidders must:

Buyer’s Premium
A 10% buyer’s premium will be added to the winning bid and will be paid by the buyer. The total purchase price will be the sum of the high bid plus the buyer’s premium. All transfer taxes and fees will be calculated based on the total purchase price.
Earnest Money Deposit (EMD)
The winning bidder is required to submit a non-refundable Earnest Money Deposit of $5,000 within 24 hours of auction end via wire transfer or certified check to Perrysburg Title (see address above).
The remaining balance of the purchase price is due within 30 calendar days of auction end. If closing does not occur within 31 days, and no written extension is agreed upon, the EMD may be released to the seller and Emerald Auction Group as liquidated damages.
Pre-Auction Offers Accepted
Pre-auction offers will be accepted and presented to Seller. To keep things fair for all parties, every pre-auction offer must follow the same terms as the auction itself, including:

All offers are treated as sight-unseen, and buyers are expected to complete all due diligence before submitting. Property access will not be granted before closing.
Offers must include proof of funds or a lender pre-approval. The seller has the right to accept, reject, or counter any offer. If accepted, the auction will be canceled and the sale will move forward under the standard auction terms.

Title & Closing
The seller will provide marketable title free of encumbrances at their expense. All liens, judgments, and encumbrances will be satisfied by the seller at closing. Buyer is responsible for their portion of closing costs. Closing will occur within 31 days of the auction close at Perrysburg Title (see address above).
The balance of the purchase price is due within 30 calendar days. If the buyer fails to close within 31 days without written mutual agreement, the Earnest Money Deposit may be released to the seller and Emerald Auction Group as liquidated damages.
Agency
Emerald Auction Group and its representatives act solely as agents for the seller.
Agent/Broker Participation
Agent and Broker participation is welcomed. A commission of 25% of the 10% buyer’s premium (paid by the buyer) will be paid at closing to a registered agent or broker whose referred client is the winning bidder and who successfully closes in accordance with the Purchase Agreement.
To qualify for compensation, the buyer’s agent must:

Complete the Agent/Broker Participation Form at least 48 hours prior to auction close

Register their client for the auction on emeraldauctiongroup.com

Attend at least one property preview with their client

Transfer of Personal Property
Any personal property left on the premises at the time of closing shall be deemed to transfer with the real estate unless otherwise stated in the purchase agreement.
